End-User Licence Agreement (EULA)

This End-User Licence Agreement (“EULA”) is a legal agreement between you and CommuGuard (Pty) Ltd (“CommuGuard”, “we”, “us” or “our”) governing your use of the CommuGuard mobile application (the “App”). By downloading, installing, registering for or using the App, you confirm that you have read, understood and agree to be bound by this EULA and by our Terms & Conditions and Privacy Policy. If you do not agree, do not use the App.
This EULA is concluded between you and CommuGuard only, and not with Apple Inc. (“Apple”) or Google LLC. CommuGuard, not Apple or Google, is solely responsible for the App and its content.
1. Licence grant
Subject to this EULA, CommuGuard grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download, install and use one copy of the App on a device that you own or control, solely for your personal, non-commercial use. Where the App is obtained from the Apple App Store, this licence is further limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules set out in the Apple Media Services Terms.
2. Emergency services & location disclaimer
The App's SOS feature uses your device's location to notify the people and partners you and your neighbourhood have configured. When you trigger an SOS, your GPS coordinates and live location are shared in-app with:
- your nominated emergency contacts;
- other CommuGuard users within approximately 500 metres of you;
- registered neighbourhood patrol volunteers; and
- a private security / armed-response partner, only where your neighbourhood or complex has been linked to one.
These recipients see your location on a map inside the App and can view your live position while the SOS is active.
CommuGuard does NOT automatically contact, dispatch or transmit your location to public emergency services (such as SAPS 10111 or emergency medical services 10177) on your behalf. The App provides a button to dial these services yourself, but placing the call is your responsibility.
Alerts depend on mobile network and data connectivity, on recipients having the App installed with notifications enabled, and on the availability of any linked security partner. We do not guarantee that any alert will be delivered, received or acted upon, or any particular response time. In any life-threatening emergency, always call SAPS on 10111 or emergency medical services on 10177 directly.
3. Location permissions
The App requests foreground and background location access so that it can display your position during the SOS and patrol features and share your live location with responders while an SOS is active. Background location during patrols and active SOS alerts is collected with your explicit consent. You may revoke location access at any time in your device settings; location-dependent features, including SOS location sharing, will not function without it. 4. Acceptable use
You agree not to: trigger false SOS alerts or submit false or misleading reports; harass, stalk, dox or surveil any person; impersonate any person or authority; reverse-engineer, decompile or disassemble the App except to the extent permitted by applicable law; or use the App for any unlawful purpose. Misuse may result in suspension or termination of your account.
5. Intellectual property
The App and all associated software, designs, text, graphics, logos and trademarks (other than content you submit) are owned by CommuGuard or its licensors and are protected by intellectual-property laws. Except for the limited licence in Section 1, no rights are granted to you.
6. Apple App Store — additional terms
The following terms apply if you obtained the App from the Apple App Store:
- This EULA is between you and CommuGuard only, and not with Apple. CommuGuard, not Apple, is solely responsible for the App and its content.
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- CommuGuard, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
- In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual-property rights, CommuGuard, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of such claim.
- You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you.
7. Google Play — additional terms
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service.
8. Disclaimer of warranties
The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, CommuGuard, its officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, including any harm arising from reliance on the App during an emergency, delayed or undelivered alerts, or the action or inaction of any alert recipient or security partner. Nothing in this EULA limits liability that cannot be limited under applicable law, including your rights under the South African Consumer Protection Act, 2008.
10. Term and termination
This EULA is effective until terminated. Your rights under it terminate automatically if you fail to comply with any of its terms. Upon termination you must cease all use of the App and delete all copies. You may delete your account at any time through our Delete account page.
11. Governing law
This EULA is governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction over any dispute arising out of or relating to it, except where applicable consumer-protection law grants you the right to bring proceedings in your country of residence.
